Below you will find the translated, simplified, and condensed version of the general terms and conditions. The Dutch-language version of the general terms and conditions shall at all times prevail in the event of any conflicts and/or differences in interpretation.

The English-language version is provided solely for clarification purposes and to assist you in understanding the applicable terms. No rights may be derived from this translation; only the Dutch-language terms and conditions are legally binding.

Article 1 – Definitions

In these terms and conditions, the following definitions apply:
1.1 Driving School: Driving School The Graduate.
1.2 Student: Natural person taking driving lessons, or their legal parent or guardian (hereinafter: “student”).
1.3 Agreement: Any arrangement between the driving school and the student.
1.4 Lesson Package: A pre-arranged package of driving lessons, possibly including an exam.

Article 2 – Applicability

2.1 These terms apply to all offers, agreements, and legal relationships between the driving school and the student.
2.2 By registration, payment, or taking lessons, the student agrees to these terms.
2.3 Deviations are only valid if agreed in writing and signed by both parties.
2.4 If any provision is null or voidable, the remaining provisions remain fully in force.

Article 3 – Formation of the Agreement

3.1 The agreement is concluded upon written registration, written confirmation of a package, or (partial) payment.
3.2 The driving school reserves the right to refuse a student without stating reasons.

Article 4 – Scheduling and Execution of Lessons

4.1 Driving lessons are scheduled via the PlanRijles system.
4.2 The student is at all times responsible for correctly scheduling lessons within the driving school’s availability.
4.3 Lessons start from fixed pick-up locations:
– Amsterdam Sloterdijk Station
– Amsterdam Lelylaan Station
– Amsterdam Zuid Station
– Amsterdam Central Station
4.4 The driving school may change instructors; no fixed instructor is assigned to a student.
4.5 Deviations from Article 4.4 are only valid if confirmed in writing by the driving school.
4.6 The driving school may reschedule, cancel, or modify a lesson due to illness, traffic conditions, weather, technical issues, or other circumstances preventing the lesson from taking place.

Article 5 – Lesson Duration

5.1 Lessons are given in blocks of 60 or 90 minutes.
5.2 If the student is late, the lesson ends at the scheduled time.
5.3 Lost lesson time due to lateness of the student will not be compensated.
5.4 In case of lateness, the full lesson fee remains payable.

Article 6 – Cancellation and No-Show

6.1 Cancellation must be made at least 96 hours (4 working days) in advance via the scheduling system.
6.2 Saturdays, Sundays, and public holidays are excluded from this calculation.
6.3 Late cancellations result in full lesson charges.
6.4 Failure to attend a scheduled lesson results in full charges.

Article 7 – Lesson Packages and Validity

7.1 Lesson packages are valid for 12 months from the purchase date.
7.2 Unused lessons expire without refund after this period.
7.3 Packages are personal and non-transferable.
7.4 The student is responsible for timely scheduling and completion.

Article 8 – Payment

8.1 All payments must be made in advance.
8.2 The first installment must be paid in full before lessons begin.
8.3 The full package price remains due even when paying in installments.
8.4 Installments must be paid monthly, regardless of lessons taken. Payment in installments is solely a payment arrangement and does not allow suspension of payments if lessons are discontinued.
8.5 In case of late payment, lessons and exams may be suspended.
8.6 If an installment remains unpaid 14 days after the due date, the full remaining balance becomes immediately due.
8.7 Administrative costs of €60.50 may be charged for installment payments.
8.8 Collection costs are calculated in accordance with applicable law and are borne by the student.

Article 9 – Exams

9.1 Exams are reserved by the driving school via the CBR system.
9.2 Exams are scheduled only after full payment of both the package and the exam.
9.3 The theory exam must be passed before scheduling a practical exam.
9.4 Changes or cancellations are only possible within 24 hours after booking; thereafter, refunds depend on CBR rules.
9.5 Absence results in full exam charges without refund.

Article 10 – Termination and Recalculation

10.1 Termination by the student must be in writing.
10.2 The driving school exclusively determines whether termination meets the criteria and whether the full package must be paid or lessons recalculated at single-lesson rates.
10.3 Acceptable reasons include, but are not limited to:
– A signed statement of incapacity by the driving school;
– Terminal, incurable, or serious illness or disability (not present at the start);
– Relocation beyond 60 minutes travel time from pick-up locations.
10.4 All discounts and package benefits lapse upon termination.
10.5 Administrative costs (€60.50) and a termination fee of at least 25% of the remaining package amount may be charged.
10.6 Only a positive balance will be refunded.
10.7 Negative balances must be paid within 14 days after termination.

Article 11 – Suspension and Termination by the Driving School

11.1 The driving school exclusively may suspend or terminate the agreement in case of non-payment, aggressive behavior, unsafe driving, rule violations, or medical unfitness.
11.2 Immediate termination is permitted if continuation cannot reasonably be expected.
11.3 Serious circumstances include, but are not limited to:
– Aggressive or dangerous behavior;
– Ignoring instructions;
– Insults or intimidation;
– Damage to property;
– Repeated no-shows (five or more);
– Repeated lateness (five or more times exceeding 20 minutes).
11.4 In such cases:
– Full payment remains due;
– No refund is granted;
– Paid amounts are not reimbursed.
11.5 The driving school may report criminal acts to authorities.

Article 12 – Conduct and Safety

12.1 Participation under the influence of alcohol or drugs is prohibited.
12.2 The student must follow instructions.
12.3 Unsafe behavior may result in immediate termination without refund.

Article 13 – Medical Fitness

13.1 The student must correctly and timely submit the health declaration to the CBR.
13.2 The student declares being physically and mentally fit to drive.
13.3 Consequences of incorrect or missing declarations are at the student’s risk.

Article 14 – Liability

14.1 The driving school is insured as required by law.
14.2 Liability is limited to the value of the service, where legally permitted.
14.3 No liability for loss or damage to personal belongings.
14.4 This limitation does not apply in cases of intent or gross negligence.

Article 15 – Force Majeure

15.1 Force majeure includes all circumstances beyond the driving school’s control. Lessons will be rescheduled.
15.2 No compensation is owed.

Article 16 – Price Changes

16.1 Prices may be adjusted if legally permitted.
16.2 Purchased packages remain at agreed prices.
16.3 If costs increase by more than 25%, the student may terminate; only completed lessons are payable.

Article 17 – Privacy

17.1 Personal data is processed in accordance with GDPR.
17.2 Data is used solely for agreement execution and communication.

Article 18 – Governing Law and Disputes

18.1 Dutch law applies.
18.2 Disputes are submitted to the competent Dutch court.

Article 19 – Right of Withdrawal

19.1 Distance agreements may be withdrawn within 14 days.
19.2 Withdrawal must be in writing or by email.
19.3 If services start within this period, proportional costs are due.
19.4 Completed lessons are charged at single-lesson rates.
19.5 The right lapses after full performance, reserved exams, or after 14 days.

Article 20 – CBR and Waiting Times

20.1 Exam scheduling depends on CBR.
20.2 No guarantees on waiting times.
20.3 Delays do not entitle refunds or compensation.

Article 21 – Identification

21.1 The student must carry valid ID at all times.
21.2 Absence of ID at exams results in full costs.
21.3 Fines or sanctions due to lack of ID are borne by the student.

Article 22 – Minimum Age and Authority

22.1 The student must meet legal age requirements.
22.2 The student confirms legal capacity and no driving ban.
22.3 Non-compliance gives no right to refund.

Article 23 – Digital Communication

23.1 Digital systems are used.
23.2 The student must provide correct contact details.
23.3 Digital communication is legally valid.
23.4 No liability for missed communication due to incorrect data.

Article 24 – Intellectual Property

24.1 Materials are property of the driving school.
24.2 Copying or distribution is prohibited without permission.
24.3 Audio recordings during lessons are strictly prohibited.

Article 25 – Complaints

25.1 Complaints must be submitted in writing within 5 working days.
25.2 The driving school responds within 10 working days.
25.3 Complaints do not suspend payment obligations.

Article 26 – Online Reviews, Defamation and Slander

26.1 Honest feedback is encouraged.
26.2 The student shall refrain from:
– Spreading incorrect information;
– Misleading representations;
– Statements solely about payment disputes;
– Defamatory statements.
26.3 Defamation includes knowingly false or harmful statements.
26.4 Unlawful content must be removed within 48 hours upon request.
26.5 Non-compliance results in a penalty of €100 per day, with a maximum of €2,500.
26.6 The driving school may request removal or take legal action.
26.7 Contractual disputes must be addressed directly with the driving school.
